Terms of Use (TOU)

The GlowUp application is a platform operated by the company Influera, allowing the connection between content creators / influencers and professional establishments, within the framework of promotional collaborations and digital communication. GlowUp offers in particular: • user profile creation, • connecting users, • internal messaging, • tools facilitating the organization and follow-up of collaborations.

2. Purpose and Scope

The purpose of these General Terms of Use (TOU) is to define the terms of access and use of the GlowUp application. They apply to any user of the platform, whether they are: • content creator / influencer, • professional establishment. The use of the GlowUp application implies the awareness of these TOU.

Users agree to: • provide accurate, complete, and up-to-date information during the creation and use of their account; • use the application in accordance with its purpose; • respect the operating rules of the platform; • adopt a professional, loyal, and respectful behavior in their exchanges; • not use the application for illegal, fraudulent, or contrary to public order purposes; • not infringe on the rights, image, or reputation of GlowUp or other users. Any failure may lead to measures provided for in Article 9 of these TOU.

5. Operation of the Platform and Role of GlowUp

GlowUp acts exclusively as a technical matching platform. Influera company: • is not a party to the agreements or collaborations concluded between users, • does not intervene in the negotiation, execution, or content of collaborations, • does not guarantee the success, quality, or outcome of collaborations. Each user remains solely responsible for their commitments, services, and relations with other users.

6. Internal Messaging and Exchanged Content

GlowUp provides internal messaging allowing users to exchange within the framework of their collaborations. Users are solely responsible for: • messages, • content, • information they transmit. GlowUp reserves the right to moderate, suspend, or restrict access to messaging in case of abuse, reporting, or non-compliance with these TOU.

7. Intellectual Property

All elements making up the GlowUp application (structure, features, texts, graphics, logos, distinctive signs, etc.) are protected by intellectual property law. Any unauthorized reproduction, representation, or exploitation is prohibited. Users retain ownership of the content they publish, while granting GlowUp a non-exclusive license, limited to the needs of the platform's operation.

8. Liability

GlowUp implements reasonable means to ensure accessibility and proper functioning of the application. However, Influera company cannot be held responsible for: • temporary service interruptions, • technical malfunctions, • indirect damages, • disputes between users, • non-compliant use of the application. The user uses the GlowUp application under their sole responsibility.

9. Failures, Sanctions, and Exclusion

Users agree to respect the commitments made within the framework of collaborations concluded via the GlowUp application, as well as to adopt a professional, loyal, and respectful behavior. In case of repeated or serious failure to meet the commitments made, particularly in case of unjustified non-execution of collaborations, inappropriate behavior, or failure to respect the obligations reminded via the application, GlowUp reserves the right, after analysis of the situation, to implement proportionate measures which may include: • issuing warnings, • temporary limitation of certain features, • account suspension, • or permanent account deletion. In case of deletion of a user's account for non-compliance with these TOU, GlowUp may inform partner establishments that the user concerned is no longer part of the platform, without disclosing details on the motives or circumstances. The decisions taken by GlowUp are based on a global assessment of the user's behavior and the elements brought to its knowledge.

10. Personal Data

The use of the GlowUp application involves the processing of personal data. The modalities of collection and processing are detailed in the Privacy Policy, accessible at any time from the GlowUp application, in the 'Your account' space, 'Settings' section.

11. Modification of the TOU

Influera company reserves the right to modify these TOU at any time. Users will be informed of modifications by any appropriate means. Continued use of the GlowUp application constitutes awareness of the updated TOU.

12. Applicable Law and Competent Jurisdiction

These TOU are subject to Algerian law. In case of dispute, and failing an amicable resolution, the competent Algerian jurisdictions shall be solely competent.

13. Information and Awareness

The General Terms of Use are accessible at any time from the GlowUp application as well as from the platform's website. Use of the GlowUp application implies awareness of these TOU.
